1. Acceptance of these terms
These Terms & Conditions ("Terms") govern your use of https://cloudcomforthvac.com (the "Site") and the heating, air conditioning and plumbing services provided by Cloud Comfort HVAC ("Cloud Comfort," "we," "us"), located at 1732 Border Ave, Torrance, CA 90501. By accessing the Site, requesting an estimate, or engaging our services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services. Where a signed service agreement, proposal or invoice exists between you and Cloud Comfort, its specific terms control over these Terms to the extent they conflict.
2. Our services
Cloud Comfort provides residential and commercial HVAC services — including air conditioning, heating, heat pumps and ductless mini-splits — plus plumbing and water heater services, in Torrance and surrounding Southern California communities. The specific scope, schedule and price of your work will be set out in a written proposal, service agreement or invoice. We may decline or discontinue service for legitimate reasons, including safety concerns, site conditions, permitting constraints or non-payment.
3. Estimates & pricing
- Estimates are non-binding. Quotes and estimates — whether given online, by phone, by text or in person — are based on the information available at the time and are informational only. Site conditions discovered during work (for example concealed ductwork, piping, electrical or code issues) may change the scope and price.
- Final pricing is confirmed before work begins. You will approve the price in writing before we start; any change orders require your approval.
- Unless stated otherwise on the document itself, written estimates are valid for 30 days from the date of issue.
- Promotions and rebates are subject to their own eligibility requirements, expiration dates and program funding, and cannot be combined unless expressly stated. Financing is subject to credit approval through third-party financing partners; Cloud Comfort is not the lender.
4. Website content & AI-assisted content disclosure
Site content is provided for general information only and is not engineering, legal or financial advice. Heating, cooling and plumbing systems differ — always have a qualified technician evaluate your specific system before acting on general guidance.
AI-assisted content. Some articles and page copy on this Site are drafted with the assistance of automated (AI) tools and are reviewed by our team before publication. Despite review, automated content can contain errors or become outdated — especially time-sensitive information such as rebate amounts, program funding and regulatory requirements. We do not guarantee that all Site content is current, complete or error-free, and we disclaim liability for actions taken in reliance on it.
5. Intellectual property
The Site and its content — text, graphics, logos, photography, video and software — are owned by or licensed to Cloud Comfort HVAC and protected by copyright, trademark and other laws. Manufacturer names, logos and marks (including Daikin) belong to their respective owners. You may view and print Site content for personal, non-commercial use; any other reproduction, distribution or modification requires our prior written permission.
6. Acceptable use
When using the Site you agree not to:
- Violate any applicable law or regulation
- Submit false, misleading or fraudulent service requests or reviews
- Interfere with the Site's operation, security or availability (including scraping, probing or introducing malicious code)
- Attempt to access accounts, systems or data you are not authorized to access
- Use the Site to transmit spam or unsolicited commercial messages
7. Warranties & disclaimers
- Equipment warranties are provided by the manufacturer and vary by product; their terms are detailed in the manufacturer's documentation. Qualifying Daikin systems we install carry the manufacturer-backed Daikin Comfort Promise and applicable Daikin parts warranties, subject to Daikin's registration requirements and conditions.
- Workmanship coverage, if any, is stated on your written service agreement or invoice.
- We are not responsible for damage resulting from misuse, neglect, alteration or repair by others, or failure to perform manufacturer-recommended maintenance.
- THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES REGARDING THE SITE, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. NOTHING IN THESE TERMS LIMITS WARRANTY RIGHTS THAT CALIFORNIA LAW DOES NOT ALLOW TO BE DISCLAIMED.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (a) Cloud Comfort HVAC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM (OR $500 FOR CLAIMS ARISING SOLELY FROM USE OF THE SITE). THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER CALIFORNIA LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.
9. Indemnification
You agree to indemnify and hold harmless Cloud Comfort HVAC and its owners, employees and agents from claims, damages and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right — except to the extent caused by our own negligence or misconduct.
10. Governing law & venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to the arbitration provision below, any dispute will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
11. Arbitration & class-action waiver
- Individual arbitration. Except for small-claims matters and claims seeking injunctive relief, any dispute arising out of these Terms, the Site or our services will be resolved by final, binding arbitration administered in Los Angeles County, California under the rules of a recognized arbitration provider (such as JAMS or AAA), before a single arbitrator. Each party bears its own attorneys' fees unless the arbitrator awards otherwise under applicable law.
- Class-action waiver. Disputes will be arbitrated on an individual basis only. Neither party may participate in a class, consolidated or representative action, to the maximum extent permitted by law.
- Your right to opt out. You may opt out of this arbitration provision and class waiver by sending written notice to 1732 Border Ave, Torrance, CA 90501 or [email protected] within 30 days of first accepting these Terms, stating your name, contact information and intent to opt out. Opting out does not affect any other provision of these Terms.
- Nothing in this section waives rights that cannot be waived under California law.
12. Severability
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver.
13. Changes to these terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Changes take effect when posted; your continued use of the Site or our services after changes take effect constitutes acceptance.

If you are a California resident, you have rights under the CCPA/CPRA regarding your personal information, including the right to opt out of the sale or sharing of personal information, and residents of other US states may have similar rights under their state privacy laws.
